Deanna R. Fischer, 39, of Hershey, was sentenced Wednesday to 364 days in the Lincoln County Detention Center.

Investigators said Fischer was complicit and took photographs of sexual assaults perpetrated by her husband Daniel in their home. She was also charged for other alleged crimes that occurred more than eight years ago.

Fischer was sentenced twice, once for sexual assault of a child and once for child abuse, but the sentences will run concurrently -- at the same time.

Fischer will get credit for the 23 days she has served in jail and she must register as a sex offender for 15 years.

Fischer was convicted in Lincoln County Court March 12. The charges were originally felonies but were reduced to misdemeanors in a plea deal with the Lincoln County Attorney’s Office.

In court Wednesday, Chief Deputy Lincoln County Attorney Tanya Roberts-Connick noted that the pre-sentence investigation did not recommend probation.

Defense attorney Michael Nozicka said it is a sad situation.

“Her husband killed himself over this and Deanna feels she has been left holding the bag.” Nozicka said. “The state couldn’t prosecute Daniel so they turned to the next best thing. It is a matter of a difference of opinion that a period of probation would be suitable for rehabilitation and that would certainly cost the state less money.”

Troshynski asked on Deanna’s behalf that she be sentenced to the county jail instead of the Hastings Correctional Center for women. He also asked for a few days for Deanna to get her affairs in order.

Lincoln County Judge Michael Piccolo agreed that it has been a difficult case.

“Obviously I don’t take sentencing in cases like this lightly,” Piccolo told Fischer. “I do, though, have to take into consideration a recurring theme in the pre-sentence investigation that shows no accountability in all this on your part.”

Based on the lack of accountability and the kind of victims involved, Piccolo said probation is not appropriate, and he ordered Fischer to be taken to the detention center directly from the court room, with no delay.

Daniel Fischer was charged with nine counts of sexual assault of a child. After the charges, while out on bail, he took his own life.
