Rogelio Diaz, 33, of North Platte pled not guilty Monday to second-degree homicide.

Diaz was arrested last summer after police found his wife, Michelle, unconscious at their home on June 25.

In court Monday, defense attorney Stephen Potter said he and the county attorney only need to speak with one more witness before a plea agreement could be reached.

“We’re trying to negotiate this,” Potter said. “If not, I’ll have some motions to file.”

Harling echoed Potter’s statement and requested more time for evidence discovery.

Rowlands continued the case until June 4. If a plea agreement is not reached by then, Rowlands said Diaz would go to trial before a 12-person jury.

According to the police, Diaz called rescue crews around 2 a.m. to the home he shared with his wife at 1920 W. 18th.

Michelle was unresponsive when rescuers arrived, police Lt. Rich Thompson said. Rescuers summoned police and took Michelle to Great Plains Regional Medical Center, where she was pronounced dead. She left two children, ages 7 and 10.

Diaz has been jailed since, held on $2 million bond.

i will more than likely get bashed for this but here goes.there was a incident with a man named Stevie and he and his wife were havin a argument she somehow hit her head and died.i can see this goin this way.not that it is right because i did not think it was right then nor do i thnk it is right on tis case.stevie had alot of people (and this is just my opinion)cover for him.very close to he people in that story but i do not know Diaz or who if any are gonna try to cover for him.the 2 womn that lost there life due to aggressive men are very missed by all.i hope the real truth comes out and he is are punished by law.because the other i refered to is punished in his mind but was nt punished b the law.

You all can sit in your computer chair and type on here why didn't she do this or that and she would still be alive BUT untill you live the life of the one who is being abused you have no clue what is going on in their mind. Yes there are all kinds of places out there that you can go and all kinds of people that will help you. But it isn't as easy as that..when you are made to think that no body wants you around..that nobody cares for you but them..you tend to believe them cuz they have you so beat down that is all you think of all the time. And then the threats start..and they tell you that if you tell anyone they will hurt the ones you love..so you take it over and over again to keep them safe..Some of you are not going to believe that this is what is going on but I can tell you that it does. Alot of the abuse is mental..they have to break you before they can hurt you. And by the time you finnaly get strong enough to get out it is to late or the abuser finds out what your plans are and it gets worse. In my case I out lived mine and I finnaly feel free..but the down side I don't know if I can trust anyone again or let anyone get that close to me again.

The reality is that in order for a victim of domestic violence to get help, they have to want the help, accept the help, and also be accountable for their actions. The police and the courts can't do a thing without the victim wanting the help and following through with the help. This means that they must participate in the criminal justice system and testify against the person who they are/were intimately invlved with. This means that if they get a protection order, they too abide by it...no "forgiving" and getting back together when the order is in place. The reality of the emotional and socioeconomic conditions work against thios process a large amount of the time. Victims have often ben isolated from family and friends, and are monetarily dependant on the abuser. Threats of death to them and any children are common. It works against the justice systyem side of things because victims have to testify. The cops can arrest, but in order to convict, the victim must help in order to help themselves. Other social and financial support is available, but a victim must still want the help and accept their responsibilities when seeking the help that is available. And before anyone reads too much into this, the victim(s) are not responsible for being victimized, they are however responsible for their actions after. The other sad reality is that this case, and cases where the victim is actually killed, are probably easier to prosecute because there is no victim to "recant" or tell a different story, or to have forgotten, or to have been too drunk to remember...

OMG AZ that was so ignorant of you to say. She was in an abusive relationship,but love is blind and she did love him. I've known them for a long time and regardless of friendships or not he deserves the worst possible punishment. Even if it was an accident "because of the drugs and alcohol" that is NO excuse. Those two things are the devil. I really hope he don't push it out to trial,because wouldn't his poor son be put on that stand since he is a witness according to the news? Them poor children have been thru enough. I hope Roger has enough respect for his children to not fight it.

Even if she asked for help would the cops listen No!! I had an ex who would stalk me and my kids, so I went got a protection Order and he sliced my tiers 2 in one week, stab my stereo and all kinds of shit the put him in jail 1 day next day he did it all over again had to move and hide cuz our cops dont care!I'm glad I got away!! I'm so sorry she didnt!

you all need to look in your own back yard nobody knows what happen you just assume but you know what they say about assuming if michelle was in such a bad relationship why didnt you people help her before something like this happened.

He needs to go before a 12 person jury. Folks need to hear what he did and how he killed Michelle. They need to know the pain and suffering of children left without a mother. He doesn't deserve a plea agreement and the jury needs to be a voice for Michelle and all the other woman in Lincoln County. These women need to know that somebody does care and justice will be served.

This is a good thing imo, with him pleading not guilty, he'll get a harsher sentence. I'm happy about the plea ;)
